Legal experts divided on tenure of President, Vice President

Kathmandu, Dec. 1: Legal practitioners have aired different views on tenure of the incumbent President and Vice-President with the fresh election to the Constituent Assembly (CA).

The Article 36 (C) of the Interim Constitution of Nepal 2063 BS has stated that the tenure of the President shall remain until the enforcement of the constitution promulgated through the CA.

At an interaction programme here today, the legal experts have expressed different opinions on the tenure of the President and Vice President.

On the occasion, President of the Nepal Bar Association (NBA) Hari Krishna Karki said that the President and Vice President should be changed as per the new mandate.

He said that the new CA meeting has the right whether to change or continue the tenure of the President and Vice President.

However, former vice-president of the NBA Sher Bahadur KC said that the CA could not go beyond the constitutional provision regarding the election to the new President and Vice President.

Similarly, former general secretary of the NBA Raman Kumar Shrestha said that election to the head of the state should be conducted after the election to the head of the government as the President holds some executive rights.

Shrestha was of the view that the President should resign on moral ground based after the fresh mandate.

Likewise, senior advocate Dr Bhimarjun Acharya said that article 36 (C) of the Interim Constitution of Nepal 2063 BS should be amended to take new decision regarding the tenure of the President and Vice President.

Also speaking at the programme, former president of the NBA Harihar Dahal said that other interpretation on tenure of the President and Vice President was unwanted prior to promulgation of new constitution. RSS
